Terms of Service

These Terms of Service (the "Terms") set out the conditions on which CloudEx Inc. ("we", "us") provides the Android app "Firewall Pro" (the "Service"). Please use the Service only if you agree to them.

1. Scope

  1. The Terms apply to every aspect of the relationship between the user and us concerning use of the Service.
  2. We may publish further rules and conditions for the Service ("Additional Terms"). Whatever they are called, they form part of these Terms.
  3. Where these Terms conflict with Additional Terms, the Additional Terms prevail unless they say otherwise.

2. What the Service is

  1. The Service is a firewall app that uses Android's VPN mechanism inside your device to allow or block network traffic per app and per network. It also blocks connections using public domain lists (filter lists), records a connection log, measures data usage, and can encrypt DNS lookups.
  2. The Service runs entirely on your device. It does not relay traffic to an external VPN server, and we do not obtain the content of your traffic.
  3. The Service is a one-time purchase; no monthly or annual charges follow it.
  4. How the Service behaves depends on your device, your Android version, your network and the other apps installed. We do not warrant that every connection will be blocked as intended, or that blocking will achieve your purpose.
  5. Android permits only one active VPN at a time, so the Service cannot be used simultaneously with another VPN app.

3. Prohibited conduct

When using the Service you must not:

  1. Break the law or offend public order and morals
  2. Engage in conduct connected with criminal activity
  3. Infringe the copyright, trademarks or other intellectual property in the Service
  4. Damage or interfere with the servers or networks of ours, of other users, or of third parties
  5. Reverse engineer, decompile or disassemble the Service, or analyse or modify its source code
  6. Install the Service on a device you have no legitimate authority over, without its user's knowledge, in order to monitor or restrict their traffic
  7. Act in a way likely to interfere with the operation of our services
  8. Gain or attempt to gain unauthorised access
  9. Use the Service for an improper purpose
  10. Do anything else we judge to be inappropriate

4. Restriction of use

  1. We may restrict your use of all or part of the Service without prior notice if:
    1. you breach any provision of these Terms; or
    2. we otherwise judge your use of the Service to be inappropriate.
  2. We accept no liability for any loss a user suffers as a result of action we take under this section.

5. Price and refunds

  1. The purchase price, payment method and other terms of payment are governed by Google Play.
  2. Whether a refund is available, and how to obtain one, is governed by our Refund Policy and by Google Play's refund policy.

6. Disclaimers

  1. We accept no liability for any loss arising from a change to, suspension of, or discontinuation of the Service.
  2. We have no involvement in, and accept no responsibility for, the environment in which you use the Service.
  3. We give no warranty that the Service is fit for your particular purpose, that it has the functions, commercial value, accuracy or usefulness you expect (including the precision and completeness of blocking), that your use of it complies with the laws or industry rules that apply to you, or that it will operate without defects.
  4. The Service is not a security product and is not a substitute for anti-malware software. The filter lists are compiled and published by third parties, and we take no responsibility for their accuracy or completeness. Blocking a domain on such a list may stop apps or services you did not intend to block.
  5. Traffic is blocked according to your own settings. Blocking may stop any app from working, including apps used for calls, messaging or emergency contact, and we accept no responsibility for the consequences.
  6. We do not warrant that the Service supports every device, OS version or network, and you accept in advance that changes to an OS or a network may cause the Service to malfunction. We do not warrant that any such malfunction will be resolved by a program fix on our part.
  7. You accept in advance that changes to an app store's terms or operating policies may restrict use of all or part of the Service.
  8. We accept no liability for any loss caused to a user, directly or indirectly, by use of the Service.
  9. We accept no liability for lost opportunity, business interruption or any other loss (including indirect loss and lost profits) suffered by a user or a third party, even if we were told in advance that such loss was possible.
  10. Sections 6.1 to 6.9 do not apply where we have acted with intent or gross negligence, or where the user is a consumer under Japan's Consumer Contract Act.
  11. Even where the preceding sentence applies, we accept no liability for loss arising from special circumstances that results from our negligence (excluding gross negligence).
  12. Where we are liable in damages in connection with the Service, our liability is limited to the purchase price the user paid us for it.

7. Changes to the Service

We may change the content of the Service or stop providing it without notice, and accept no liability for any loss this causes a user.

8. Personal information

We handle personal information and user information properly, in accordance with our separate Privacy Policy.

9. Changes to these Terms

We may change these Terms at any time without notice where we judge it necessary. A user who continues to use the Service after a change is deemed to have agreed to the amended Terms.

10. Governing law and jurisdiction

  1. These Terms are governed by and construed in accordance with the law of Japan.
  2. Any dispute concerning the Service is subject to the exclusive jurisdiction of the court having jurisdiction over our registered office.
